Terms of Service

Last updated: 14 March 2025

These Terms of Service govern your use of withrefute.com and the Refute content authenticity and manipulation detection platform (together, the "Service") operated by Refute Ltd ("the Company," "we," "us," or "our") (1 Bath Street, London EC1V 9BW). By accessing or using the Service, you accept these Terms in full. If you are acting on behalf of an organisation, you represent that you have authority to bind that organisation.

Refute is designed for enterprise brand safety teams, newsroom trust desks, and communications professionals who need to score the authenticity of stories and accounts and detect coordinated inauthentic behaviour. These Terms reflect that commercial context while preserving your statutory rights.

Nothing in these Terms limits your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer-protection law.

1. Agreement

These Terms constitute the agreement between you and Refute Ltd (1 Bath Street, London EC1V 9BW) governing your use of the Service. By registering for an account, placing an order, or otherwise using the Service, you confirm your acceptance. If you do not agree, do not use the Service.

2. Use of the Service

  • You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Service.
  • You may use the Service only for its intended purpose: authenticating and scoring content, accounts, and network behaviour patterns in connection with brand safety, editorial trust, or related professional functions.
  • You agree not to use the Service for any unlawful purpose, to harass, surveil, or target individuals without a legitimate professional basis, to attempt unauthorised access to any part of the platform, or to interfere with its operation.
  • You may not copy, scrape, resell, or reverse-engineer the Service or its underlying models except as expressly permitted by law or by written agreement with the Company.
  • You are responsible for all activity on your account. Credentials must be kept confidential; notify us immediately if you suspect unauthorised access.

3. Intellectual Property

The Service, including its scoring models, detection algorithms, user interface, documentation, and all associated content, is owned by Refute Ltd or its licensors and is protected by UK and international intellectual-property law. You receive a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the purposes described in these Terms. No rights in the Service are transferred to you beyond this licence. Refute branding, trade marks, and product names may not be used without prior written consent.

4. User Content and Submitted Data

You are responsible for all content and data you submit to the Service, including URLs, account identifiers, and content samples. By submitting data, you represent that you have the right to do so and that doing so does not violate any applicable law or third-party rights. You grant Refute Ltd a limited licence to process submitted content for the sole purpose of providing the scoring and detection service to you. We do not use submitted content to train or improve our models without your explicit written consent. Please also review our Privacy Policy for how submitted data is handled.

5. Right to Cancel (Consumer Contracts Regulations 2013)

Where you enter into a paid distance contract with us as a consumer, you have a 14-day right to cancel from the date of the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, email [email protected] with a clear cancellation statement. We will refund any payment received within 14 days of receiving your notice. Please note that for digital services consumed immediately with your prior agreement, this right may be limited.

6. Disclaimers and Statutory Rights

The Service is provided on an "as is" and "as available" basis. Refute's scored outputs are analytical assessments based on available signals; they are not legal determinations and should not be treated as conclusive evidence of inauthenticity or manipulation. Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under the law of England and Wales. Consumer statutory rights, including those under the Consumer Rights Act 2015 regarding satisfactory quality and reasonable care and skill where applicable, are not affected by these Terms.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Refute Ltd's total aggregate liability to you for all claims arising from or related to the Service, whether in contract, tort (including negligence), or otherwise, will not exceed the greater of GBP 100 or the fees paid by you for the Service in the three months preceding the event giving rise to the claim. This limitation does not apply to liability that cannot be limited under mandatory law.

8. Termination

We may suspend or terminate your access to the Service with notice if you breach these Terms in a material way and fail to remedy the breach within 14 days of written notice. We may suspend access immediately without notice where there is a security risk or serious breach. Sections 3 (Intellectual Property), 6 (Disclaimers), 7 (Limitation of Liability), and 9 (Governing Law) will survive termination.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising from or in connection with these Terms or the Service, subject to your right as a consumer resident in the United Kingdom to bring proceedings before the courts of your place of residence.

10. Changes

We may update these Terms from time to time. Material changes will be communicated by posting updated Terms with a new "Last updated" date. Continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.
